R. Civ. P. 71.1(d), you are hereby notified that a condemnation action has been filed in the United States District Court for the District of Maryland (the “Court”) by the National Railroad Passenger Corporation (“Amtrak”) to acquire by eminent domain your fee simple interest in the following property: all real property and all improvements located at 2036 West Lanvale Street in Baltimore City, Maryland 21217, recorded among the Baltimore City Property Location Block Plats as Ward 16 - Section 05 - Block 0082 - Lot 017 (the “Subject Property Interest”). The action is captioned National Railroad Passenger Corporation (Amtrak) v. .025 Acres More of Less of Land, et al., Case No.: 1:22-cv-02349-RDB. Amtrak is authorized under 49 U.S.C. § 24311 to obtain interests in property necessary for intercity rail passenger transportation through condemnation. Amtrak requires the Subject Property Interest as part of the Baltimore and Potomac (“B&P”) Tunnel Replacement Program, which will modernize and transform a four-mile section of the highly traveled rail network known as the Northeast Corridor. By this action, Amtrak asserts and exercises its right under 49 U.S.C. § 24311(a)(1)(A) to acquire the Subject Property Interest by eminent domain. Please be advised Amtrak has deposited with the Court the amount it estimates to be just compensation for the Subject Property Interest in accordance with statutory requirements. Joseph T. Flores, Charm City Redevelopment Two, LLC, and/or any other interested party may serve upon the Plaintiff’s attorneys an Answer to the Complaint in the aforementioned action within twenty-one (21) days after service of this Notice. Failure to serve an Answer constitutes consent to the taking and to the authority of the Court to proceed to hear the action and to affix the compensation.
